Hire Terms & Conditions
Definitions of Law
1.1 The Equipment shall mean marquees, tables, chairs, lighting, flooring, generators, simulators or any other items hired from Premier Marquee Hire And Entertainments.
1.2 The “Customer” is the person, firm, corporate or public body, hereafter referred to as “You” or “The Customer”, hiring the equipment.
1.3 The “Company” is Premier Marquee Hire And Entertainments. Hereafter referred to as “Us” “We” or “The Company”
1.4 Consequential Loss shall mean loss of profits, contracts or any other consequential loss or damages.
1.5 The contract shall be interpreted and applied in accordance with presiding law and the Parties to this contract agree to submit to the exclusive jurisdiction of regional courts.
Charges & Cancelations
2.1 The charges due are as stated and agreed on the Booking form or invoice.
2.2 Hire charges start from the date and times stated in the booking form and are payable for the period of hire.
2.3 Equipment will be delivered by us in a clean and respectable condition for your hire on the date and time specified in the contract, and on collection the equipment must be in a clean and representable condition. (see 12.1 and 12.2)
2.4 In event of a breach of these conditions or the equipment not being available for use by other customers, the customer will pay the full daily hire rate together with consequential loss.
2.5 At the discretion of Premier Marquee Hire And Entertainments, the customer may be charged in full for the equipment they have hired if it is cancelled within 2 days up until the day of there hire date. If the customer cancels within 3 days 50% of there booking total or from the date the booking was made until 7 days prior it will be 25% of there booking total.
2.7 Any legal or other charges incurred in the recovery of money or of equipment shall be paid by the customer.
2.8 All charges are payable on demand and failure to pay any invoices will then be passed on to Advocate commercial dept recovery which are a member of the chartered institute of credit management (CICM), membership number Wayne graham 6018833 and commissioners office registration number ZA094782 and registered with the data protection act and Financial Conduct Authority (FCA). If any of our unpaid invoices are passed to Advocate Commercial Dept Recovery they will increase the outstanding balance by 15%.
Hire Period
3.1 The hire period commences and terminates at the times specified and agreed in the booking form or invoice.
Booking fee and Payments
4.1 A 25% deposit may be charged at the discretion of Premier Marquee hire And Entertainments on bookings under £500 and a 50% deposit on bookings £500 and over . All bookings deposits are non-refundable under any circumstances. But you may transfer to another date and equipment if required.
Customers Responsibilities
5.1 The customer’s responsibility for the equipment commences on receipt of the equipment, and terminates when the Company collects the equipment.
5.2 At no time shall the customer sell, dispose or otherwise part with control of the equipment.
5.3 It is the customer’s responsibility that everyone who uses the equipment has been instructed in its safe and proper operation, and further will not allow the equipment to be misused.
5.4 Premier Marquee Hire And Entertainments or any of its employees can not be held responsible for any financial loss, personal injury or damage to or loss of any property arising as a result of the use of the equipment. Premier Marquee Hire And Entertainments can not be held liable for any financial loss or loss of business caused by equipment failures, equipment misuse or failure to supply equipment or services in any circumstances.
5.5 The equipment must not move from the allocated site specified when the erection team arrives without prior authorisation from Premier Marquee Hire And Entertainments.
Damage Or Theft
6.1 The customer agrees to pay Premier Marquee And Hire And Entertainments the full replacement cost of any equipment lost, stolen or damaged beyond economic repair.
6.2 In the case of equipment that is lost, stolen, or damaged beyond economic repair, the customer shall pay a charge at the full daily rate together with consequential loss until the equipment is replaced or paid for in full.
6.3 The customer shall insure the equipment against the above liability or you can have one of our staff members to supervise your equipment for a cost of £30 per hour which includes full use of our 10 million public liability.
Condition of returned equipment
7.1 The customer is fully responsible for the care, safekeeping and return in good order of the equipment.
7.2 The customer will reimburse all costs incurred by Premier Marquee Hire And Entertainments in rectifying the condition of any equipment returned damaged or unclean, and in addition will pay a charge at the fully daily hire rate together with consequential loss for a reasonable period until the condition is rectified.
Termination of hire
8.1 Premier Marquee Hire And Entertainments shall be entitled to terminate the hire with immediate effect and to repossess the equipment at any time if the customer is in breach of these terms.
8.2 Such termination shall not affect the right of Premier Marquee Hire And Entertainments to recover from the customer any money due under the contract, consequential loss or damages for breach.
Equipment.
9.2 It is the customer’s sole responsibility to make sure the equipment you have hired fits in the space were it is required to be placed. If when we turn up with equipment on the day of your hire it does not fit you will be charged the full amount of that hire. all sizes and space required is available to view when booking just click on the size tab beside each piece of equipment.
Vehicles on site
10.1 It is the customer’s responsibility to provide suitable means of access for our vehicles onto and around the site as required.
Equipment Availability
11.1 If, in the unlikely event, the exact equipment you have booked to hire form us is unavailable for whatever reason, Premier Marquee Hire And Entertainments agrees to supply equipment that is suitable for the original intended purpose.
Ownership
12.1 The equipment shall at all times remain the absolute property of Premier Marquee Hire And Entertainments and the hirer shall have no rights to the equipment.
13.1 Windy conditions, in the event of windy conditions you can use this Beaufort scale to judge whether the conditions are safe to use the inflatable. The scale starts at force 0 which is calm and goes all the way to force 12 which would be a hurricane force wind. In the event the wind is exceeding force 5 which is a wind speed of between 19-24 mph everyone should vacate the inflatable and be deflated immediately and then only re inflated once winds have subsided.
